A Penrith woman who swung a metal object at her dad and pulled hair from his partner’s head during a late night visit to their home has been banned from contacting the pair for a year.
Rebekah Smaile’s offending, on 26th May last year, occurred against a background of domestic difficulties, Carlisle magistrates were told.
Smaile (31) had gone to the home of her father, who initially heard her speaking and went outside. He saw Smaile was holding something in her hand which she swung, causing him to take evasive action. The item was a metal boot-puller which was swung at him but did not make contact.
During the incident the man’s partner — Smaile’s stepmother — tried to push her away. But as she did so, Smaile grabbed a chunk of her hair and pulled it out. She then kicked a nearby light motion sensor, leaving wires hanging out.
Smaile, of Carleton Drive, Penrith, admitted two charges of assault by beating and one of criminal damage.
The stepmother had described a “major impact” on her life in the aftermath.
Smaile admitted three offences at the earliest opportunity and had, according to defence solicitor Trystan Roberts, shown “an enormous amount of remorse” for her wrongdoing. “She regrets the incident. It arises out of a history of difficulty with her father,” said the lawyer.
Smaile accepted inadvertently swinging the object at her father on the night, having initially tripped over it. She admitted grabbing the woman’s hair but did not believe a lot had been pulled out.
Magistrates passed sentence after considering a detailed probation service pre-sentence report.
A 12-month community order comprising alcohol treatment and a rehabilitation requirement was imposed, along with a £120 fine and costs. Smaile was banned from having any contact with her father and his partner — and from approaching their Penrith address — for a year.
