A pensioner whose hens and cockerels roam outside his Penrith home has been slapped with a court order banning the birds from roaming during certain hours of the day.
Brian Boyes, 74, of Tynefield Drive, appeared at Carlisle Magistrates’ Court last Wednesday where a complaint was made against him under the Environmental Protection Act 1990.
The complaint was sought to prohibit a statutory nuisance — namely an alleged unreasonable amount of noise from cockerels, hens and other avian breeds which were alleged to continuously wander on and around the informant Tim Wilson’s property.
The complaint was granted and an order made banning the cockerels from roaming freely outside Mr Boyes’ home at all times.
The hens are prohibited from roaming freely outside of his home between 5pm and 9am daily.
