An initial hearing date has been set for the legal challenge which has been launched in an attempt to stop the £1.5 billion A66 improvement scheme.
Transport Action Network (TAN), a small national transport campaign group, has been told the hearing will take place at the High Court in London on October 23.
Plans to create a full dual carriageway between Penrith and Scotch Corner were given the go-ahead by the Secretary of State for Transport in March.
But TAN has lodged a legal challenge to the granting of that Development Consent Order.
Of the High Court date, a spokesman for the group said: “This will hopefully allow us to take our challenge to the next stage.”
A spokeswoman for National Highways told the Herald: “We can confirm that a date has been set for an initial hearing on the A66 legal challenge at the High Court for October 23.
“This will be to decide whether to grant or reject the legal challenge. We’re unable to comment any further, in line with pre-election guidance.”
